落实未成年人保护法 健全未成年人学校保护体系

——教育部政策法规司负责人就《未成年人学校保护规定》答记者问

  2021年6月1日,教育(yu)(yu)部部长陈宝生(sheng)签署中华人民(min)共和国(guo)教育(yu)(yu)部令第50号,公布《未成(cheng)年人学校保护规(gui)定(ding)》(以下简称《规(gui)定(ding)》),自(zi)2021年9月1日起(qi)施(shi)行。教育(yu)(yu)部政(zheng)策法规(gui)司(si)负责(ze)人就《规(gui)定(ding)》有关问(wen)题(ti)回答了(le)记者提问(wen)。

  1. 问:请简单介绍一下制定《规定》的背景和过程?

  答(da):未(wei)成(cheng)(cheng)年(nian)(nian)(nian)(nian)(nian)人(ren)是祖国(guo)的(de)未(wei)来。党中央、国(guo)务(wu)院高度(du)重(zhong)视未(wei)成(cheng)(cheng)年(nian)(nian)(nian)(nian)(nian)人(ren)保(bao)(bao)(bao)护(hu)(hu)工作(zuo),就(jiu)此(ci)作(zuo)出一系(xi)(xi)列(lie)重(zhong)大(da)决策部(bu)署(shu)。2020年(nian)(nian)(nian)(nian)(nian)10月,习近(jin)平总书(shu)记签(qian)署(shu)主席令,颁布新修订(ding)的(de)未(wei)成(cheng)(cheng)年(nian)(nian)(nian)(nian)(nian)人(ren)保(bao)(bao)(bao)护(hu)(hu)法,新法于今年(nian)(nian)(nian)(nian)(nian)6月1日(ri)起(qi)施行(xing),其中专章对学(xue)(xue)校(xiao)保(bao)(bao)(bao)护(hu)(hu)作(zuo)出规定。保(bao)(bao)(bao)护(hu)(hu)未(wei)成(cheng)(cheng)年(nian)(nian)(nian)(nian)(nian)人(ren)是全社会(hui)的(de)职(zhi)责,也是学(xue)(xue)校(xiao)的(de)法定义(yi)务(wu)。近(jin)年(nian)(nian)(nian)(nian)(nian)来,教育部(bu)和(he)地方教育行(xing)政部(bu)门不(bu)(bu)断加强和(he)改(gai)进(jin)中小学(xue)(xue)管理(li),出台了一系(xi)(xi)列(lie)文(wen)(wen)件,近(jin)期又出台了加强“五项管理(li)”等(deng)有(you)关文(wen)(wen)件,取(qu)得了明显成(cheng)(cheng)效。但是,学(xue)(xue)校(xiao)未(wei)成(cheng)(cheng)年(nian)(nian)(nian)(nian)(nian)人(ren)保(bao)(bao)(bao)护(hu)(hu)中仍然存在着对保(bao)(bao)(bao)护(hu)(hu)职(zhi)责认识不(bu)(bu)全面(mian)、相关制度(du)可操(cao)作(zuo)性不(bu)(bu)强、保(bao)(bao)(bao)护(hu)(hu)体(ti)制机制不(bu)(bu)健全等(deng)问(wen)题,迫(po)切需要系(xi)(xi)统(tong)整合现有(you)制度(du)、构建未(wei)成(cheng)(cheng)年(nian)(nian)(nian)(nian)(nian)人(ren)学(xue)(xue)校(xiao)保(bao)(bao)(bao)护(hu)(hu)的(de)制度(du)体(ti)系(xi)(xi),把中央要求(qiu)和(he)上(shang)位法规定落(luo)细(xi)落(luo)实,提升学(xue)(xue)校(xiao)未(wei)成(cheng)(cheng)年(nian)(nian)(nian)(nian)(nian)人(ren)保(bao)(bao)(bao)护(hu)(hu)工作(zuo)效能。

  2018年(nian)(nian),教(jiao)育(yu)部即着(zhe)手研(yan)(yan)究(jiu)建立(li)学校(xiao)未成年(nian)(nian)人(ren)(ren)保护(hu)(hu)制度,在(zai)新修订(ding)的(de)未成年(nian)(nian)人(ren)(ren)保护(hu)(hu)法发(fa)布(bu)后(hou),加(jia)快推(tui)进起草工(gong)作,委托相关高校(xiao)、研(yan)(yan)究(jiu)机构开(kai)展课题研(yan)(yan)究(jiu)论证,先后(hou)赴上(shang)海、江苏、四川等地开(kai)展深入(ru)调(diao)研(yan)(yan),广泛(fan)听取(qu)基层教(jiao)育(yu)部门、学校(xiao)、教(jiao)师(shi)和(he)学生家长的(de)意见,并征求了全国人(ren)(ren)大常(chang)委会法工(gong)委、最高人(ren)(ren)民检察院、公安部、民政部等部门意见。在(zai)此基础(chu)上(shang)形(xing)成了《规定》,于2021年(nian)(nian)6月1日正式发(fa)布(bu)。

  2. 问:《规定》的适用范围是什么?

  答(da):《规(gui)(gui)(gui)定(ding)(ding)》的(de)主(zhu)要(yao)(yao)适(shi)用范围是(shi)普(pu)通中小学(xue)(xue)(xue)校(xiao)、中等(deng)职业学(xue)(xue)(xue)校(xiao)。幼(you)儿(er)园(yuan)(yuan)、特殊教(jiao)(jiao)育(yu)学(xue)(xue)(xue)校(xiao)有(you)(you)更多的(de)保(bao)护(hu)(hu)(hu)(hu)、保(bao)育(yu)、照(zhao)护(hu)(hu)(hu)(hu)要(yao)(yao)求(qiu),因此规(gui)(gui)(gui)定(ding)(ding)其(qi)要(yao)(yao)依据《规(gui)(gui)(gui)定(ding)(ding)》落实(shi)对(dui)(dui)学(xue)(xue)(xue)生(sheng)权益的(de)保(bao)护(hu)(hu)(hu)(hu)要(yao)(yao)求(qiu),并参照(zhao)《规(gui)(gui)(gui)定(ding)(ding)》结合实(shi)际建立相(xiang)应(ying)保(bao)护(hu)(hu)(hu)(hu)制度,有(you)(you)针(zhen)对(dui)(dui)性地(di)加(jia)强对(dui)(dui)未(wei)成(cheng)年(nian)人的(de)保(bao)护(hu)(hu)(hu)(hu);但是(shi)对(dui)(dui)于幼(you)儿(er)园(yuan)(yuan)、特殊教(jiao)(jiao)育(yu)学(xue)(xue)(xue)校(xiao)及(ji)其(qi)教(jiao)(jiao)职工侵害在(zai)园(yuan)(yuan)、在(zai)校(xiao)未(wei)成(cheng)年(nian)人合法(fa)权益的(de),应(ying)当适(shi)用《规(gui)(gui)(gui)定(ding)(ding)》第七(qi)章的(de)问责(ze)方式从重予以(yi)处理。考(kao)虑到《规(gui)(gui)(gui)定(ding)(ding)》主(zhu)要(yao)(yao)针(zhen)对(dui)(dui)学(xue)(xue)(xue)校(xiao)这一特定(ding)(ding)组(zu)织构建全(quan)面保(bao)护(hu)(hu)(hu)(hu)体系,而培训机(ji)构、托育(yu)机(ji)构等(deng)不(bu)具备(bei)学(xue)(xue)(xue)校(xiao)的(de)组(zu)织架(jia)构,因此并未(wei)规(gui)(gui)(gui)定(ding)(ding)其(qi)适(shi)用《规(gui)(gui)(gui)定(ding)(ding)》,但有(you)(you)关机(ji)构仍应(ying)当落实(shi)未(wei)成(cheng)年(nian)人保(bao)护(hu)(hu)(hu)(hu)法(fa)的(de)要(yao)(yao)求(qiu),可以(yi)参考(kao)《规(gui)(gui)(gui)定(ding)(ding)》建立健全(quan)内部的(de)管理制度。

  3. 问:《规定》主要保护学生的哪些权益?

  答:《规定(ding)》遵(zun)循全(quan)面保(bao)护(hu)(hu)的(de)原则,依据宪(xian)法(fa)(fa)、民法(fa)(fa)典、未成(cheng)年人(ren)保(bao)护(hu)(hu)法(fa)(fa)、教(jiao)(jiao)育(yu)法(fa)(fa)等(deng)(deng)(deng)法(fa)(fa)律(lv),系统规定(ding)了学(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)应当保(bao)护(hu)(hu)的(de)未成(cheng)年人(ren)基本权(quan)(quan)利,即平等(deng)(deng)(deng)权(quan)(quan)、生(sheng)(sheng)(sheng)命健康与自(zi)(zi)由、人(ren)格权(quan)(quan)、隐(yin)(yin)私权(quan)(quan)、受(shou)教(jiao)(jiao)育(yu)权(quan)(quan)、休息权(quan)(quan)、财产权(quan)(quan)、肖像权(quan)(quan)和(he)(he)(he)知(zhi)识产权(quan)(quan)、参与权(quan)(quan)、申(shen)诉权(quan)(quan)等(deng)(deng)(deng)权(quan)(quan)利,专设“一般保(bao)护(hu)(hu)”一章予以(yi)规定(ding)。其(qi)中也有(you)很(hen)多新的(de)提法(fa)(fa)和(he)(he)(he)要(yao)(yao)求,比(bi)如,针对(dui)(dui)一些学(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)出(chu)于安全(quan)和(he)(he)(he)便(bian)于管(guan)理的(de)需要(yao)(yao),限(xian)制学(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)课(ke)间活(huo)动(dong)和(he)(he)(he)同学(xue)(xue)(xue)(xue)(xue)(xue)之间正常交(jiao)往,不(bu)利于营造(zao)生(sheng)(sheng)(sheng)动(dong)活(huo)泼的(de)教(jiao)(jiao)育(yu)生(sheng)(sheng)(sheng)态(tai)、保(bao)护(hu)(hu)学(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)活(huo)力和(he)(he)(he)全(quan)面发(fa)展(zhan)的(de)情况,明确提出(chu):学(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)不(bu)得设置侵犯学(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)人(ren)身自(zi)(zi)由的(de)管(guan)理措(cuo)施,不(bu)得对(dui)(dui)学(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)在课(ke)间及(ji)其(qi)他非教(jiao)(jiao)学(xue)(xue)(xue)(xue)(xue)(xue)时间的(de)正常交(jiao)流、游戏、出(chu)教(jiao)(jiao)室活(huo)动(dong)等(deng)(deng)(deng)言行(xing)自(zi)(zi)由设置不(bu)必(bi)要(yao)(yao)的(de)约束(shu)。再比(bi)如,《规定(ding)》禁止学(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)、教(jiao)(jiao)师(shi)公开学(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)的(de)考试(shi)成(cheng)绩和(he)(he)(he)排名,出(chu)发(fa)点(dian)是保(bao)护(hu)(hu)学(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)隐(yin)(yin)私和(he)(he)(he)自(zi)(zi)尊心,减少攀比(bi)、避(bi)免歧(qi)视,缓解应试(shi)压力;但是同时规定(ding)学(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)应当采取措(cuo)施,便(bian)利家长知(zhi)道学(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)的(de)成(cheng)绩等(deng)(deng)(deng)学(xue)(xue)(xue)(xue)(xue)(xue)业(ye)信息。此外,《规定(ding)》落(luo)实“破五唯(wei)”的(de)要(yao)(yao)求,明确禁止学(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)宣传升学(xue)(xue)(xue)(xue)(xue)(xue)情况,避(bi)免唯(wei)分数、唯(wei)升学(xue)(xue)(xue)(xue)(xue)(xue)率对(dui)(dui)学(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)和(he)(he)(he)学(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)进行(xing)评价,以(yi)营造(zao)良好的(de)教(jiao)(jiao)育(yu)生(sheng)(sheng)(sheng)态(tai)和(he)(he)(he)学(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)发(fa)展(zhan)环境。

  4. 问:《规定》就防治欺凌建立了哪些工作机制?

  答:校(xiao)园(yuan)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)是(shi)近(jin)年(nian)来中央(yang)关(guan)心、社会(hui)关(guan)注、群众关(guan)切的(de)(de)(de)(de)(de)(de)(de)教(jiao)育领域热点难点问题(ti)(ti)。此(ci)前教(jiao)育部(bu)等(deng)(deng)部(bu)门就防(fang)(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)校(xiao)园(yuan)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)印发(fa)(fa)了(le)专门文件(jian),新修订的(de)(de)(de)(de)(de)(de)(de)未成(cheng)(cheng)年(nian)人保(bao)护法(fa)也对(dui)此(ci)做(zuo)了(le)专门规(gui)定(ding)(ding)(ding)(ding)。《规(gui)定(ding)(ding)(ding)(ding)》将(jiang)有关(guan)要(yao)求(qiu)(qiu)(qiu)(qiu)进(jin)一(yi)(yi)步具(ju)体(ti)(ti)化,进(jin)行(xing)(xing)(xing)(xing)了(le)科(ke)学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)的(de)(de)(de)(de)(de)(de)(de)制(zhi)(zhi)度设计,构建(jian)(jian)了(le)防(fang)(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)的(de)(de)(de)(de)(de)(de)(de)规(gui)则体(ti)(ti)系。一(yi)(yi)是(shi)明确(que)学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)的(de)(de)(de)(de)(de)(de)(de)概(gai)念。规(gui)定(ding)(ding)(ding)(ding):学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)之(zhi)间(jian)(jian),在(zai)(zai)年(nian)龄、身(shen)(shen)体(ti)(ti)或(huo)(huo)者(zhe)人数等(deng)(deng)方(fang)面占优势的(de)(de)(de)(de)(de)(de)(de)一(yi)(yi)方(fang)蓄意(yi)(yi)或(huo)(huo)者(zhe)恶意(yi)(yi)对(dui)另(ling)一(yi)(yi)方(fang)实施相关(guan)行(xing)(xing)(xing)(xing)为(wei)(wei),或(huo)(huo)者(zhe)以其(qi)他方(fang)式欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)压(ya)、侮(wu)辱(ru)另(ling)一(yi)(yi)方(fang),造成(cheng)(cheng)人身(shen)(shen)伤(shang)害、财产损(sun)(sun)(sun)失或(huo)(huo)者(zhe)精神损(sun)(sun)(sun)害的(de)(de)(de)(de)(de)(de)(de),可(ke)以认(ren)定(ding)(ding)(ding)(ding)为(wei)(wei)构成(cheng)(cheng)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)。这一(yi)(yi)概(gai)念强(qiang)调了(le)主体(ti)(ti)上(shang)(shang)的(de)(de)(de)(de)(de)(de)(de)特定(ding)(ding)(ding)(ding)性(xing)(xing)、主观上(shang)(shang)的(de)(de)(de)(de)(de)(de)(de)故(gu)意(yi)(yi)性(xing)(xing)、后(hou)果上(shang)(shang)的(de)(de)(de)(de)(de)(de)(de)伤(shang)害性(xing)(xing),有助(zhu)于把学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)和(he)(he)校(xiao)园(yuan)暴(bao)力、学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)间(jian)(jian)正常(chang)的(de)(de)(de)(de)(de)(de)(de)嬉闹(nao)等(deng)(deng)区别开(kai)来。二是(shi)明确(que)学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)的(de)(de)(de)(de)(de)(de)(de)行(xing)(xing)(xing)(xing)为(wei)(wei)表现(xian)(xian)(xian)。《规(gui)定(ding)(ding)(ding)(ding)》归纳了(le)侵犯身(shen)(shen)体(ti)(ti)、侮(wu)辱(ru)人格、侵犯财产、恶意(yi)(yi)排斥、网络诽谤或(huo)(huo)传播隐私(si)等(deng)(deng)五类欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)行(xing)(xing)(xing)(xing)为(wei)(wei),为(wei)(wei)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)认(ren)定(ding)(ding)(ding)(ding)和(he)(he)处(chu)(chu)(chu)(chu)理(li)(li)提(ti)供具(ju)体(ti)(ti)指引。三(san)是(shi)建(jian)(jian)立(li)(li)学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)预(yu)(yu)防(fang)(fang)机制(zhi)(zhi)。规(gui)定(ding)(ding)(ding)(ding)了(le)学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)教(jiao)育制(zhi)(zhi)度和(he)(he)调查评估制(zhi)(zhi)度,要(yao)求(qiu)(qiu)(qiu)(qiu)学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)教(jiao)育引导学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)建(jian)(jian)立(li)(li)平等(deng)(deng)、友(you)善、互助(zhu)的(de)(de)(de)(de)(de)(de)(de)同学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)关(guan)系,开(kai)展防(fang)(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)专题(ti)(ti)教(jiao)育;要(yao)求(qiu)(qiu)(qiu)(qiu)学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)定(ding)(ding)(ding)(ding)期(qi)针对(dui)全体(ti)(ti)学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)开(kai)展防(fang)(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)专项调查,对(dui)学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)是(shi)否存在(zai)(zai)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)等(deng)(deng)情形(xing)进(jin)行(xing)(xing)(xing)(xing)评估。四是(shi)建(jian)(jian)立(li)(li)学(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)欺(qi)(qi)(qi)(qi)(qi)(qi)(qi)凌(ling)(ling)(ling)(ling)(ling)(ling)(ling)关(guan)注、干预(yu)(yu
